Terms and Conditions
Last updated: 21 October 2026
The short version
- FurBrains is for families. A parent or guardian aged 18 or over holds the account and is responsible for how it's used.
- Your FurBrain uses AI. It's designed to be kind and age-appropriate, but it can make mistakes and isn't a replacement for a grown-up or a professional.
- Spark Coins are for fun inside FurBrains. They have no cash value.
- Your rights under consumer law, including the New Zealand Consumer Guarantees Act, always apply.
1. About these terms
These terms are an agreement between you and FurBrains Limited, a company based in New Zealand ("FurBrains", "we", "us" or "our"). They apply when you use the FurBrains parent app, FurBrain toys and their online services, FurBrainia (the FurBrains game) and our website (together, the "Services").
By creating an account or using the Services, you agree to these terms and to our Privacy Policy, which explains how we handle your family's information. If you don't agree, please don't use the Services.
2. Who can use FurBrains
- To create an account, you must be at least 18 and the parent or legal guardian of any child you add.
- Children can use their FurBrain toy and FurBrainia through your family account, with your permission. You're responsible for your children's use of the Services and for the settings you choose for them.
- FurBrains is designed for children aged 3 to 11. We recommend that grown-ups keep an eye on how younger children play, as they would with any toy or app.
3. Your account
- You sign in with a one-time code sent to your email, or with Google or Facebook. Keep access to your email and phone secure, because anyone who can access them may be able to sign in to your account.
- Please give us accurate information and keep it up to date.
- Let us know straight away at support@furbrains.app if you think someone else has accessed your account.
- You can invite other adults in your household to help manage your family. You're responsible for who you invite.
4. Using FurBrains
- Your FurBrain needs the parent app to be set up and managed. It also needs Wi-Fi to talk and play, and Bluetooth for setup.
- You're responsible for your own internet and mobile data costs.
- We work hard to keep FurBrains running smoothly, but we can't promise it will always be available or free of errors. We may sometimes need to pause the Services for maintenance or updates.
- We may send updates to the parent app and to your FurBrain's software to fix problems, improve safety or add features. Some updates may be needed for FurBrains to keep working.
- Your FurBrain toy itself, including its warranty, is also covered by the information that comes with it.
5. AI features
Your FurBrain and Firefly, the helper in the parent app, use artificial intelligence to talk, answer questions and make suggestions. We design them to be kind, age-appropriate and guided by the Guiding Lights and guardrails you set. Please keep in mind:
- AI can get things wrong. Replies may sometimes be inaccurate, incomplete or not quite right for your family. Please check anything important.
- It's not professional advice. FurBrains supports play, learning and talking about feelings. It isn't medical, psychological, educational or other professional advice, and it isn't a substitute for a parent, teacher, doctor or counsellor. If you're worried about your child's health, safety or wellbeing, please talk to a qualified professional. In an emergency, call your local emergency number.
- Tell us if something's wrong. If your FurBrain or Firefly says something that worries you, please tell us at support@furbrains.app so we can look into it and improve.
6. Spark Coins, wallet and purchases
- Spark Coins are a virtual reward your children can earn by completing tasks and can use in FurBrains. They have no cash value. They can't be exchanged for money, transferred, or sold, except where the law requires otherwise.
- Purchase requests: children can ask for things in the shop, but nothing that costs real money is bought without a parent's approval.
- Prices are shown in the app before you buy. Purchases made through the App Store or Google Play are processed by Apple or Google under their terms and refund policies.
- Wallet balances can only be used within FurBrains.
- Plans: if we offer a paid plan, we'll clearly show what it costs and how it renews before you sign up, and you can cancel at any time.
- We may change or stop offering particular shop items, coin packs or plans. This won't affect your rights under consumer law.
7. Rules for using FurBrains
When using the Services, please don't:
- use them for anything unlawful or harmful, or to harm or exploit children,
- try to get our AI to produce harmful or inappropriate content,
- try to access other people's accounts or information,
- copy, change, reverse engineer or interfere with the parent app, the FurBrain's software or our servers, except as the law allows, or
- use automated tools to access the Services or overload them.
8. Our content and your content
- The FurBrains name, characters, FurBrainia, artwork, stories, software and other content belong to FurBrains Limited or our licensors.
- We give you a personal, non-exclusive, non-transferable licence to use the parent app and your FurBrain's software for your family's personal, non-commercial use, in line with these terms.
- You own what you create and share in FurBrains, such as your family's Guiding Lights, tasks and wishlists. You give us permission to use it only to provide and improve the Services for you, as described in our Privacy Policy.
9. Ending your account
- You can delete your account at any time from the parent app's settings, or by emailing us. We'll delete your family's information as described in our Privacy Policy.
- We may suspend or close an account if it seriously or repeatedly breaks these terms, or if we need to protect children, other families or the Services. Where it's reasonable, we'll tell you first and give you a chance to put things right.
- If we ever stop offering the Services, we'll give you reasonable notice.
10. Consumer rights and liability
If you're a consumer, you have rights that can't be excluded, including under the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986, the Australian Consumer Law and similar laws where you live. Nothing in these terms limits those rights.
To the extent the law allows:
- we provide the Services "as is" and don't make promises about them beyond those in these terms and those the law requires,
- we aren't responsible for loss that wasn't reasonably foreseeable, or that was caused by things outside our reasonable control, and
- if we're responsible for loss, our total liability is limited to the amount you've paid us in the 12 months before the claim. This limit doesn't apply where the law doesn't allow it.
11. App Store and Google Play
If you downloaded the parent app from Apple's App Store or Google Play:
- these terms are between you and FurBrains Limited, not Apple or Google, and FurBrains Limited is responsible for the app and its content,
- Apple and Google have no obligation to provide maintenance or support for the app,
- if the app fails to meet a warranty that applies, you can notify Apple, and Apple may refund the purchase price (if any). To the extent the law allows, Apple has no other warranty obligation for the app,
- Apple and Google aren't responsible for handling any claims relating to the app, including product liability claims, consumer protection or privacy claims, or claims that the app infringes someone else's intellectual property,
- you confirm you're not located in a country subject to US government embargo, or on a US government list of prohibited or restricted parties, and
- Apple and its subsidiaries are third-party beneficiaries of these terms, and can enforce them against you.
You must also follow the app store's own terms of use.
12. Changes to FurBrains and these terms
FurBrains will grow and change over time. We may update these terms to reflect changes to the Services or the law. If a change is important, we'll tell you in the app or by email before it takes effect. If you keep using the Services after that, you're agreeing to the updated terms. If you don't agree, you can delete your account.
13. Governing law
These terms are governed by New Zealand law, and New Zealand courts can hear any dispute about them. If you live in another country, you also keep any protections and rights to bring a claim that your local law gives you.
